UK Work Visa

The UK is an amazing place to live – There are many different immigration routes to gain access or remain in the UK in order to work. These vary from highly skilled to sponsored categories, whether on a permanent or temporary basis and have been designed to attract professionals from a cross section of industries.

Although there have been many changes around this section over recent years it remains a popular route of entry to the UK. Dependant on the visa type that is granted this may enable you to extend your stay in the UK in future and may lead to permanent residency which is known as Indefinite Leave to Remain.

Do I qualify for a UK Work Permit?

Although the Tier 1 General category is now closed to all applicants, if you have been issued a Tier 1 General or HSMP (transitional arrangements) before this category was closed, you may be able to apply for an Extension and must do so before the 5th of April 2015

Tier 1 General (Extension) visa entitles all applicants to:

  • Live and work in the UK
  • A route to settlement

In order to apply for a Tier 1 General Extension, an applicant must satisfy the following minimum requirements:

  • Must be living and working the UK
  • Score a minimum of 95 points or 100 points for attributes which includes UK experience, Qualifications, Previous Earnings, Age, Maintenance and English Language
  • Must meet the genuine Tier 1 General test

Successful applicants will receive an extension for the duration of two or three years (depending on the length initially issued to you). When you have completed two or three years, you may be able to apply for Indefinite Leave to Remain (ILR) and must do so before the 5th of April 2018

The Tier 1 Post Study work category closed on 05 April 2012. All graduates wishing to apply under this category needed to have done so before this date. Should you wish to stay in the UK you may apply under any other categories available, should you qualify.

What is the Sponsorship Process for Businesses in the United Kingdom?

The Tier 2 Sponsorship License provides a company with a license to sponsor and employ persons who are non EU or British Nationals.

The license entitles the company to issue a Certificate of Sponsorship, which will then be used in support of a Work Permit or Intra Company Transfer visa application provided the applicants are eligible to apply.

What are the requirements?

In order to apply for a Sponsorship License the company will need to ensure that they are compliant and meet specific criteria:

  • Your business must be operating legally within the UK, documentary evidence will need to be supplied validating important elements such as tax, insurance, etc…
  • You will need to allocate specific staff to administer specific HR and immigration responsibilities
  • Your company will need to be compliant with UK immigration law and all employees must have be employed legally

The Tier 2 General Work Permit is issued to applicants who are sponsored by a company that holds a Tier 2 Sponsorship License.

Tier 2 General Work Permit visa entitles all successful applicants to:

  • Live and work in the UK temporarily
  • A route to settlement

In order to apply under this visa category to the UK, an applicant must satisfy the points requirement of 70 – this would include points allocated for:

  • Maintenance, money saved to evidence you are able to support yourself and your dependants
  • English Language Requirement
  • A sponsor and a valid Certificate of Sponsorship will need to be provided by the sponsoring company
  • Resident Market Labour Test may apply
  • Job must be on the graduate occupation list or on the shortage occupation list

The Tier 2 General Work Permit for the UK can be issued initially for a validity period of up to 3 years or 5 years. Extension applications may be made at the end of this term to bring your total stay in the UK to 6 years. After a period of five years under this category the applicant may be eligible to apply for Indefinite Leave to Remain (ILR).

The Tier 2 Intra Company Transfer (Tier 2 ICT) visa is issued to applicants who are transferred to a UK Branch from another branch oversees. The company would need to hold a Tier 2 Sponsorship License.

Tier 2 ICT Work Permit visa entitles all successful applicants to:

  • Live and work in the UK temporarily

In order to apply for a visa under this category, an applicant must satisfy the points requirement of 70 – this would include points allocated for:

  • Maintenance, money saved to evidence you are able to support yourself and your dependants
  • English Language Requirement

A visa under this category can be issued for maximum periods of 6 months, 1 year, 5 years or 9 years (depending on the sub category). After this period, applicants may need to return to their country, as this route is not traditionally a route to permanent residence in the UK.

The Tier 5 Youth Mobility Scheme previously known as the working holiday visa is a fantastic opportunity for 18 – 30 year old citizens of reciprocating countries to visit and work in the UK.

The working holiday visa allows successful applicants to take up most types of employment however there are some restrictions with regards to self employment and other occupations. The visa entitles all applicants to:

  • Live and work in the UK
  • Study in the UK

The applicant must be able to meet the following requirements:

  • Must be between the ages of 18 – 30
  • Must be citizens of reciprocating countries; Australia, Canada, Japan, New Zealand, Monaco, Hong Kong*, Taiwan* and Republic of Korea*
  • Must show the equivalent of £1890.00 in available funds

* You will need to be sponsored if you are from any of these countries

Once a Tier 5 Youth Mobility visa is issued for an applicant, it will not be issued for a second time for the same person.

The Sole Representative Business visa is one of the options for oversees companies or an employee of an overseas newspaper, news agency or broadcasting organisation posted on a long-term assignment to the UK wishing to set up an office or expand the business interests into the UK. The company would identify one individual in their employ to carry out this function.

The person applying for the Sole Rep visa to the UK cannot be a Director or primary share holder of the sponsoring company and they will need authority to carry out the day-to-day operations of the business. The visa entitles all applicants to:

  • Live and work in the UK for the sponsoring employer
  • The visa may be extended
  • Dependants may be added to the application

In order to apply for a Sole Representative Visa to the UK, an applicant must satisfy the following minimum requirements:

  • Must have been employed within a full time capacity by the company sponsoring the visa
  • Must have full authority to make decisions in the day to day running of the business
  • Must have sufficient maintenance to support themselves and dependants, this may be sponsored by the company.
  • Meet the English Language requirement

The visa may be extended which could lead to the applicant qualifying for Indefinite Leave to Remain (ILR)

The UK domestic Worker visa allows employers to bring their established members of staff to the UK for a period of up to 6 months. Domestic workers include cleaners, chauffer’s, cooks or those that provide personal care such as nannies.

In order to apply for a Domestic Worker visa, an applicant must satisfy the following minimum requirements:

  • Must be 18 – 65 years of age
  • Intend to leave the UK at the end of 6 months, or at the same time as your employer
  • Must be able to support themselves without recourse to public funds

Dependants cannot be included on your application; if they wish to enter the UK they will need to do so within their own right, such as on a UK Visitor Visa

The Domestic Worker Visa may be extended, and can lead to Indefinite Leave to Remain (ILR) only if you were already in the UK on this visa before the 5th of April 2012
